Performances for Various Musical Events
Welcome to Legacy Music Lessons’ Performance Events. By attending, participating in an event held by LML and/or hiring LML for a music event, you agree to be bound by these Terms and Conditions.
Assumption of Risk and Waiver of Liability
A. Assumption of Risk: By attending the Event, you voluntarily assume all risks and dangers incidental to the Event, whether occurring before, during, or after the performance. This includes risks of injury, property damage, illness (such as exposure to communicable diseases like COVID-19), or death.
B. Release of Liability: You hereby release, waive, and discharge the Event Organizer, the venue, performers, and their respective affiliates from any and all claims, liabilities, damages, or causes of action arising from your attendance at the Event, whether caused by negligence or otherwise.
AI Malfunction: You acknowledge that AI technology can be unpredictable and may not always perform as expected. The Event Organizer is not responsible for any musical outputs, errors, or other performance issues caused by the AI system.
B. Limitation of Liability: To the maximum extent permitted by law, the Event Organizer and its affiliates shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your attendance at the Event, including but not limited to any damage to your property or devices.
C. Indemnification: You agree to indemnify, defend, and hold harmless the Event Organizer from any claims, damages, or expenses (including legal fees) arising from your actions or omissions at the Event, including any violation of these Terms.
C. Medical Consent: You consent to any medical treatment deemed advisable in the event of an injury or illness during the Event and release all involved parties from responsibility for such actions.
Conduct and Venue Policies
A. Prohibited Items: You agree to abide by all venue policies regarding prohibited items, which may include, but are not limited to: weapons, illegal substances, outside food and beverages, large bags, professional cameras, and recording devices. All attendees and their belongings are subject to search upon entry.
B. Behavioral Standards: You agree to conduct yourself in a respectful and non-disruptive manner. Any behavior deemed a safety risk or excessively disruptive, including excessive intoxication, may result in your immediate removal from the Event without refund.
D. Photography and Recording: Unauthorized commercial audio, video, or photographic recording of the Event is strictly prohibited. Any unauthorized recordings may be confiscated or deleted. By attending, you consent to being photographed or recorded for promotional purposes and waive any rights to compensation related to such use.
Intellectual Property and AI-Generated Content
A. Performance Rights: The performers and artists own the intellectual property rights to their musical compositions and performances. By attending, you agree not to infringe on these rights.
B. Promotional Usage: The Event Organizer and its affiliates may use your likeness, image, voice, or name in any media for promotional, marketing, or commercial purposes without compensation.
A. Ownership of AI-Generated Content: The musical compositions and sound recordings performed at the Event that are generated entirely by AI are generally considered to be in the public domain and are not subject to copyright protection.
B. Ownership of Collaborative Content: In the case of AI-assisted music, where human creativity is combined with AI, copyright protection may apply. The ownership of such works is governed by separate agreements between the Event Organizer and the artists involved.
C. Unauthorized Use: You agree not to copy, reproduce, or use any portion of the musical performances for any commercial or non-commercial purpose without express written consent. This includes, but is not limited to, creating derivative works, training AI models, or distributing recordings.
D. Recording and Use of Likeness: You may not record, film, or photograph any part of the Event for commercial use. Any images, video, or audio recordings you capture are for personal, non-commercial use only. By attending, you grant the Event Organizer the right to use your likeness in promotional materials without compensation.
Disputes and Governing Law
A. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions.
B. Arbitration Agreement: In the event of a dispute, you and the Event Organizer agree to resolve the matter through binding arbitration, waiving any right to a jury trial or class action lawsuit. The arbitration shall take place in Indiana.
C. Informal Dispute Resolution: Before initiating arbitration, you agree to participate in good faith in informal dispute resolution with the Event Organizer to attempt to resolve the issue.
Privacy
Your personal information is collected and processed in accordance with the Event Organizer’s Privacy Policy. By attending the Event, you consent to this Privacy Policy, available at privacy policy.
